If you do not agree with any of these terms, you are prohibited from using or accessing this Website. The materials contained in this Website are protected by applicable copyright and trademark law.

Disclaimer for U.S. Citizens and Residents

Please note that due to legal and regulatory restrictions, our services are not available to citizens, residents, or persons otherwise located in the United States. By accessing or using our website and services, you represent and warrant that you are not:

Users

The Website is offered and available to users who meet the minimum age requirement applicable in their jurisdiction. Website Materials and Functionalities

The Website Materials refer to all content, data, and resources available on the Website, including but not limited to text, images, graphics, logos, videos, software, design elements, downloadable resources, and any other materials made available for viewing or downloading (hereinafter the “Materials”). This includes proprietary information protected by copyright, trademarks, and other intellectual property laws, whether owned by the Website or third-party licensors, and is subject to the terms outlined in this agreement.

These Terms of Use permit you to use the Materials for your personal, noncommercial use only. Additional functionalities and features available on the Website include:

  • Wallet Integration: Users may link and manage cryptocurrency wallets, such as MetaMask, to store, send, and receive Graphite tokens and other supported cryptocurrencies. This integration allows seamless interaction with blockchain services on the Website. Users are responsible for ensuring the security of their wallet credentials. We do not store or manage users' wallet information.
  • Buy Graphite Page: A dedicated page where users can purchase Graphite tokens using supported cryptocurrencies. Users must ensure compliance with local laws regarding cryptocurrency transactions and acknowledge that they assume all associated risks.
  • Developer Grants Page: A section for developers to apply for grants supporting innovative projects related to the Graphite ecosystem. By applying for a grant, developers agree to abide by additional terms specified on the grants page.
  • Airdrop Page: A timed feature where users can participate in campaigns by completing specific tasks or quests to earn points. At the conclusion of the airdrop, the prize pool is divided among users based on their accumulated points. Details, including deadlines and participation terms, are available on the airdrop page.
  • Cross-Network Bridge: Available here, the bridge service allows users to transfer and receive Graphite tokens across different blockchain networks. Users must review the supported networks and acknowledge the risks associated with cross-chain transfers.
  • Graphite Wallet: Available soon, this wallet allows users to manage and transfer Graphite tokens and other supported digital assets. Users are advised to use this tool responsibly and acknowledge that they bear the risk of asset management.
  • Blockchain Explorer and API Documentation: Users can explore blockchain transactions and other data through the Graphite blockchain explorer. API keys, available through user accounts, allow for blockchain data queries per the documentation here. API keys are provided for free but come with a request limit per second. Misuse of the API may result in suspension or revocation of access.
  • Data Privacy and Security: Users are responsible for maintaining the confidentiality of their account information and for any activity that occurs under their account. We are not responsible for losses or damages resulting from unauthorized access to user accounts or breaches due to user negligence.

Prohibited Conduct

Users agree not to engage in the following prohibited activities:

  • Using automated systems (e.g., bots) to interact with the Website without express permission.
  • Engaging in any activity that interferes with or disrupts the proper functioning of the Website, including introducing viruses or harmful code.
  • Using the Website for fraudulent or illegal activities.
  • Attempting to bypass any measures implemented to prevent or restrict access to any portion of the Website.
  • Engaging in unauthorized data scraping or mining of blockchain data for commercial purposes without appropriate licensing or consent.

Limitation of Liability and Indemnification

You agree to indemnify and hold us harmless from any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in connection with your violation of these Terms of Use or any applicable law.

In no event shall we be liable for any indirect, special, incidental, or consequential damages (including loss of profit, data, or business interruption) arising out of the use or inability to use the Website and its functionalities, even if we or an authorized representative has been advised of the possibility of such damages.

User Content and Contributions

If you choose to contribute content to any section of the Website (e.g., user reviews, forum discussions), you grant us a non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute this content for the operation and promotion of the Website. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of Estonia. Disputes arising out of or related to these Terms will be resolved through binding arbitration under the rules of the Estonian Chamber of Commerce and Industry. The arbitrator’s decision will be final and binding, and arbitration will occur in Estonia. Parties waive their right to litigation in the courts.
